Noida: There is good and happy news for the people buying houses in Noida. Noida Authority has now taken a strict stand regarding the arbitrariness of builders in Noida. The Authority has made a Tripartite Agreement mandatory for the purchase of flats in any builder’s project in the district. This decision has been taken in the board meeting of the Noida Authority. Under this decision, all three – flat buyers, real estate company and authority – will be involved. This will let the authority know who bought that house at the time of the first payment i.e. down payment. Currently, the authority gets to know this information at the time of completion, during the last payment or registry.

This decision has been taken in the board meeting led by Noida Authority Chairman Lokesh M. This is expected to bring transparency in the real estate sector. Along with this, black marketing will stop and suspicious sales and transactions of houses will also be stopped. This will protect the interests of home buyers. Also, due to proper transactions, revenue in the form of stamp duty will increase. The period given by the builder for the completion of the project can also be monitored properly.

The builder will not be able to take more than 10% advance payment before the sale agreement for any apartment

The sale agreement between the builders and the buyers is the most important document before registration, under which all the rules and regulations of the sale and everything till the completion date are mentioned. According to Section 13 of RERA, it has been strengthened further. It states that the builder will not be able to take more than 10% advance payment before the sale agreement for any apartment, via or flat etc. He will also not be able to take any application fee. Therefore, now a tripartite agreement has been made, under which there will be a tripartite agreement between the builder, buyers and Noida Authority. After paying 10% of the property amount, this agreement will be done in the registry department between the builder, buyer and Noida Authority. Under this agreement, a 2% stamp duty will also have to be paid. The remaining amount will have to be paid at the time of possession i.e. getting possession of the house and at the time of final registration.

Know the new rules of the Noida Authority

The Noida Authority says that the person buying the property through a tripartite agreement (Noida Authority) will have a strong document or record in his hands because his name will be registered in the stamp and registry records (Flat Registry).

With this, the developer will not be able to sell the same unit to many home buyers simultaneously. They will not be able to cancel any sale agreement arbitrarily

With this, if the flat buyer sells the same flat or property back to the builder without paying the stamp or sells it to another buyer without paying tax before taking possession, that will also be curbed through the new norms.

At present, the builder and flat buyers make a sale agreement on a stamp paper of Rs 100. The role of the Noida Authority comes into play only when the developer obtains the Occupancy Certificate and Completion Certificate i.e. the certificate of completion of the project.

The sale agreement contains important things like the carpet area of ​​the flat, the full price, other types of offers, payment methods and the period of giving possession. Therefore, if a tripartite agreement is reached, the builder will not be able to show reluctance in keeping up to the promises made.
