UP RERA caps transfer charges, Noida Highrise Federation welcomes move against arbitrary builder fees

According to the new UP RERA guidelines, builders and developers will no longer be allowed to impose arbitrary transfer charges during property ownership transfers.

Noida: In a major relief for homebuyers and apartment owners, the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has amended Regulation 47 and fixed a maximum limit on transfer charges. The revised order, notified on March 25, 2026, has been welcomed by the Noida Highrise Federation, which called it a landmark decision in favour of consumers.

According to the new UP RERA guidelines, builders and developers will no longer be allowed to impose arbitrary transfer charges during property ownership transfers.

Noida Highrise Federation President Nikhil Singhal said the new regulation would provide significant relief to residents who were often forced to pay excessive charges during property transfers.

The amendment in Regulation 47 is a major step towards protecting consumer rights. Builders will now not be able to recover unreasonable transfer charges from buyers and residents.

Transfer within family or blood relations

For transfer of property to family members or blood relatives, the maximum processing fee has been capped at ₹1,000.

However, residents will need to submit:

  • Death certificate
  • Succession certificate
  • NOC from other legal heirs
Transfer to third party

For transfers to non-family members or third parties, the maximum transfer charge cannot exceed ₹25,000.

No fresh agreement required

UP RERA has also clarified that no new sale or lease agreement will be executed for such transfers. Instead, the change will be recorded through an endorsement in the existing agreement itself.

Federation raises concern over illegal charges

The federation stated that despite existing regulations, several builders are still allegedly collecting excessive transfer charges from residents under different heads. Nikhil Singhal urged residents to refuse payment of any amount beyond the limits prescribed by UP RERA and immediately file complaints if builders attempt to force illegal charges.

Focus on transparency and consumer protection

According to UP RERA Chairman Sanjay Bhoosreddy, the amendment has been introduced to make the grievance redressal mechanism more transparent, effective and consumer-friendly. The Noida Highrise Federation has also announced that it will run awareness campaigns across highrise societies to inform residents about the revised transfer charge rules and their legal rights under the RERA framework.
