Allahabad High Court stays Supertech Ecovillage-1 AOA elections until the deed of declaration is corrected, following residents’ objections over equal voting percentages for flats of different sizes.

Greater Noida West: The Allahabad High Court has stayed the proposed Apartment Owners Association (AOA) elections at Supertech Ecovillage-1 in Greater Noida West until corrections are made to the project’s deed of declaration.

During the hearing of a petition filed by residents of the society, Justice Siddharth Nandan questioned the Deputy Registrar on whether the deed of declaration had been corrected. The court directed that the election process must not proceed until the required corrections are made.

The court also made it clear that the designated election officer cannot proceed with the elections without the correction of the deed of declaration.

Residents raise concerns over equal voting percentage

The residents who filed the petition argued that the existing deed of declaration assigns the same voting percentage to all flats, irrespective of their size. They maintained that voting rights should be proportional to the size of the flats.

The petitioners clarified that they were not opposed to holding the AOA elections but wanted the process to be conducted fairly and in accordance with the applicable rules.

According to the residents, they had earlier approached the Deputy Registrar seeking corrections to the voting percentage. However, the election process continued without the necessary changes being made.

Election process began after August 2025 order

The Deputy Registrar, Ghaziabad, issued an order in August 2025 for conducting elections in the society.

After the election process began, residents approached both the Deputy Registrar and the designated election officer, requesting that voting percentages be determined according to flat sizes.

However, the residents alleged that both authorities declined to make the requested changes, stating that correcting the deed of declaration was not their responsibility and that the elections would be conducted according to the existing provisions.

The issue led to resentment among residents, who argued that assigning equal voting percentages to flats of different sizes was unfair and contrary to the applicable provisions of the Uttar Pradesh Apartment Act.

With the High Court’s intervention, the proposed election process now remains subject to the correction of the deed of declaration, as directed by the court.
