Greater Noida West : The Allahabad High Court has delivered a significant judgment, granting major relief to residents of Tower-12 in the Panchsheel Hynish project located in Greater Noida West. The court has directed the Greater Noida Industrial Development Authority (GNIDA) to complete the registry (sub-lease) process of 29 flat owners who filed the petition within 90 days.
It is noteworthy that out of the total 12 towers in Panchsheel Hynish, the registry for Tower-11 and Tower-12 had been pending for a long time. While more than 150 families are residing in Tower-12, the court’s order currently applies only to the 29 residents who pursued legal action. These flat owners had paid stamp duty years ago and had already taken possession of their homes, yet the registry process remained incomplete due to alleged technical reasons.
Residents knocked on every door, Received only assurances
Before approaching the court, residents repeatedly contacted the builder and the authority but received only assurances with no concrete resolution. Eventually, 29 flat owners came together and decided to seek legal recourse. They bore the entire legal cost themselves. Key petitioners included Saurabh Thukral, Shaival Goswami, Pritam Soni, Nishant Kumar Jha, and Kranti Mishra. Their case was strongly represented in court by senior advocate Santosh Kumar Singh.
Loan pressure added to residents’ distress
Due to the delay in the registry, residents faced both mental stress and financial pressure. Many had taken home loans and were under constant pressure from banks to submit registry documents. Failure to do so on time also posed the risk of penalties.
After hearing all parties, the court ruled in favour of the residents and directed the concerned authorities to complete the process within 90 days. Following the verdict, a wave of relief and happiness spread among the residents of Tower-12.
This is not just a victory for 29 families but a victory for justice. This decision would pave the way for relief to other affected residents as well.
