Noida: The controversy has been deepening continuously since the elections held in September 2024 in the Eldeco Aamantran, Noida Sector-119. According to the society bylaws, after the selection of 5-5 members from both teams, the executive officers should have been selected by the election board. However the Deputy Registrar’s Office is not following this process and the selection process is being carried forward through GBM, due to which there is dissatisfaction among the residents.
Residents demanding to follow the process as per byelaws
Many residents of Eldeco Aamantran have been continuously demanding to follow the process as per the bylaws, but till now neither the DR office has shared any clear rules, nor has any answer been given to the questions raised by them. One of the two observers appointed in the last six months made it clear in his report that most of the elected members want the executive to be formed as per the bylaws and not through GBM. Despite this, the Deputy Registrar’s office recently appointed a new observer, who seems to be inclined towards GBM-based selection. They have issued the notice of GBM without discussing it with any elected member and without explaining the procedure.
DR was clearly asked under which rule the office bearers are being elected in GBM when it is against clause 18 of the bylaws of the society.
DR was also asked if he could give an example of any society where office bearers were selected in GBM after the election. But no reply has been received from the DR office to date. Similarly, the East Region also asked for the rules from DR in writing, to which no reply was given.
Also, here no copy of any notification has been given to the Secretary of the Society. The secretary clarified that he neither received any information about the change of observer nor has any communication been established by the new observer. Even in the letter issued for the GBM, nothing has been sent in writing to the secretary. The vice-president said that the new observer is communicating with only one party, while no discussion has been held with the rest of the elected members.
The residents have demanded intervention in this process from the District Magistrate Gautam Budh Nagar, local MP Dr Mahesh Sharma and other officials.
We have not been given any clear information about the process of the VBM nor the subjects to be discussed and decided. This not only raises questions about transparency but also makes it seem that the process is being rushed. Giving only 7 days’ notice is not only inconsistent but also limits the participation of most members. At least 30 days’ notice should be given for such a meeting so that every member has a full opportunity to prepare as per their schedule and the democratic process is respected.

We should be told clearly what is going to happen in the GBM—whether there will be voting and if there is, it should be through secret ballot. Voting by show of hands is neither the right way nor transparent. We have not even been told yet what exactly is to be done in the GBM. No agenda has been shared for the GBM yet, and without an agenda, the GBM cannot be held.” Residents say that when 531 members voted in the election, the formation of a working committee with the participation of only 50 people in the GBM is improper and unconstitutional. For this reason, they are now considering approaching the court.
