NCLAT Order Revived Hope for Stalled Supertech Projects

Noida : Thousands of homebuyers, including residents of Eco Village–2 in Greater Noida West, are awaiting a crucial Supreme Court hearing scheduled for December 17, 2025. The case relates to the completion of 16 long-stalled Supertech projects and is being closely watched by affected families.

On December 12, 2024, the National Company Law Appellate Tribunal (NCLAT) directed that 16 stalled Supertech projects be completed through NBCC (India) Limited. The order was seen as a major relief for homebuyers who have been waiting for possession for over a decade.

Supreme Court stay halted NBCC’s entry

Soon after the NCLAT order, Apex Heights Pvt. Ltd. obtained a stay from the Hon’ble Supreme Court, claiming that provisions of the Insolvency and Bankruptcy Code were not fully followed while passing the order. Due to the stay, NBCC could not take over the projects or begin construction work.

Homebuyers and welfare associations filed several Interlocutory Applications before the Supreme Court in support of NBCC. However, repeated adjournments due to matters of national importance delayed hearings and extended uncertainty for buyers.

Case details and next hearing

The matter is currently listed as Civil Appeal No. 2626/2025 – Apex Heights Pvt. Ltd. vs. Ram Kishor Arora. The case is being heard by a Bench of Hon’ble Justice Surya Kant and Hon’ble Justice Joymalya Bagchi. The next hearing is scheduled for December 17, 2025, a date now seen as critical by homebuyers across multiple stalled projects.

Eco Village–2 welfare association’s stand

The Eco Village–2 Welfare Association, Greater Noida West, represented by its President Mohan Lal Sinha and Secretary K.K. Kalra, along with association members and the monitoring team, has clearly stated that completion of the project through NBCC is the only practical and fair solution.

The Association believes that completing such a large and complex housing project through a private builder within a fixed timeline is not feasible. Past disputes involving Apex Builders have further added to homebuyers’ concerns.

Project delayed for over 15 years

The Eco Village–2 project was launched in 2009. Even after more than 15 years, thousands of families are still waiting for possession of their homes, making it one of the longest delayed housing projects in Greater Noida West.

Appeal to the Supreme Court and government authorities

The Welfare Association has appealed to the Hon’ble Supreme Court, Prime Minister Narendra Modi and Uttar Pradesh Chief Minister Yogi Adityanath to expedite the handover of the Eco Village–2 project to NBCC. The Association has also demanded full implementation of the NCLAT order and vacation of the stay that continues to stall construction work.

Homebuyers remain hopeful that NBCC, with its experience in completing stalled projects, will finish the Eco Village–2 project within a stipulated timeframe and bring long-awaited relief and justice to thousands of affected families follow-up format
