Greater Noida West: A fresh controversy has erupted at ATS Happy Trails, Greater Noida West, after residents accused the builder of conducting the Apartment Owners Association (AOA) elections in an unfair and misleading manner. Residents have alleged that the builder is “manipulating the system” and collecting crores of rupees every month without transparency.

Residents further claimed that after the earlier AOA was annulled, the builder conducted fresh elections in violation of norms. They have demanded strict action from the authorities, including @AtsHomekraft, @UPRERAofficial, @myogiadityanath, @dmgbnagar, @noida_authority and @ChiefSecyUP, seeking an impartial investigation into the matter.

Registrar’s office cites compliance with rules

Meanwhile, an official order issued by the Deputy Registrar, Firms, Societies and Chits, Ghaziabad, has stated that the Happy Trails Apartment Owners Association was formed with the consensus of the majority of owners and in compliance with the regulations of the state government.

According to the document, the complainant himself actively participated in the AOA formation process and contested for the position of General Secretary. However, as per the registrar’s findings, over 79% of the residents did not support him. The order adds that instead of accepting the democratic outcome, the complainant filed a “baseless and frivolous complaint,” which the registrar rejected under the Doctrine of Estoppel. The order further notes that the elections were conducted transparently via e-voting on May 31 and June 1, 2025, through the government-recognized platform Right2Vote, which is approved by the Ministry of Home Affairs.

Registrar highlights fair process

The registrar’s office mentioned that adequate notice and explanations were given to all flat owners prior to the election. To ensure maximum participation especially for residents living abroad or outside the complex, the e-voting system was chosen. The process was spread over two days to facilitate participation and resulted in nearly 79% voter turnout. The complaint filed against the election was therefore dismissed, and the AOA registration was allowed to proceed as per the rules.

Residents continue to express dissent

Despite the registrar’s clarification, a section of residents remains dissatisfied. They allege that the entire election process was influenced by the builder and lacked genuine transparency. Some residents are now reportedly exploring legal options to challenge the election and the registration order.
