Deputy Registrar’s significant decision on AOA’s mistake in the 3.5 crore painting dispute.

The procedures of the AOA of 11th Avenue Gaur City-2, Greater Noida West have been deemed incorrect. The Deputy Registrar has issued an important order regarding the long-standing 3.5 crore painting dispute in the society located in Greater Noida West. The order considered the current AOA (Apartment Owners Association) procedures to be incorrect and clearly directed that the painting contract must be re-aligned with the UP Apartment Act. The AOA’s tenure was nearing its end, yet the contract was given. According to information, there has been a dispute between the residents and the AOA for months regarding repairs and painting during the rainy season. Residents alleged that the AOA awarded the contract without consent and forcibly during the election time. In fact, the AOA’s term ended on June 29, and the election for the new AOA is scheduled for August 24. Thus, the awarding of the contract is considered against the rules.

Order of the Deputy RegistrarThe Deputy Registrar stated in his order that:The new AOA (Association of Apartment Owners) will have to undergo the entire process again by holding a GBM (General Body Meeting).An auditor has been appointed to examine the financial transactions from 2021 to 2025.No financial transactions for painting will be allowed until the auditor and the new AOA submit their reports.Residents’ ResponseResidents have welcomed this decision. They say that this is the first time in the history of 11th Avenue that the Deputy Registrar has questioned the procedures of the AOA.Resident Ashish Bisht said –”If the AOA itself does not adhere to the bylaws, how will residents be encouraged to follow the rules of the society?”

Now the focus is on the new AOA, which must complete the process with transparency as per the orders of the deputy registrar. Residents hope that after this decision, transparency and accountability in the society will increase.
