The real estate company ATS Home Private Limited has informed the Allahabad High Court that the Noida authority has failed to carry out the prior directive, which stipulated that sufficient land must be granted for the establishment of Sports City in Sector 152 of Noida.
A group of businesses could submit a proposal for the 503,000 square meter plot allotment in accordance with the plan. A total of 393,276.75 square meters of land were awarded to the consortium, which included ATS Homes’ offer on behalf of the ten companies. The Noida authority was suggested to acquire the remaining 109,723.25 square meters of land.
Additionally, the developer informed the court that rather of using their own judgment, the state government had just restated the Noida authority’s position.
A plan to allocate a land in Sector 152 for an international cricket stadium and sports city was proposed by the Noida authorities in 2015. Sports facilities were not developed by the developer, who instead added a few storeys to the project’s residential and commercial buildings. In January 2021, the Noida authorities issued a block on the sale and purchase of flats and plots in the project, citing that the real estate company should provide public sports facilities before constructing dwelling units. The developer insisted, nevertheless, that they do not have enough property for the same.
The high court has instructed Manish Goel, the state’s additional advocate general, to present the Uttar Pradesh government’s position at the upcoming hearing on April 3, 2024, in light of the ATS Group’s representations.
The Noida authorities was ordered by the Allahabad High Court in September 2023 to submit a counter-affidavit in response to a writ filed by ATS Homes in September 2022, which claimed that it had not yet received 109,723.25 square meters (sqm) of housing land in Noida’s Sector 152.
In addition to requesting more time to complete the housing project and payment waivers for the time lost in allotting the remaining land, the petition questioned the authority’s decision to revoke the allocation.
The Noida government began to revoke the allotment when the developer filed a writ petition, claiming that the real estate firm had not completed the project by the deadline.
According to the ATS, of the 125 acres granted for the project in 2015, the authority has not yet turned over ownership of roughly 25 acres.
ATS pleaded with the high court to order the authorities to release the whole parcel of property that was granted, free of any encroachments, and within a certain amount of time. Additionally, it requested that the authority give it a “zero period” during which lease payments and other related interests are suspended until the full transfer of the land.
The ATS Homes attorney stated during the March 11, 2024, hearing that the April 2023 high court order had not been followed.
Chief executive officer Lokesh M of the Noida Authority responded, “We will look into the matter,” when a response was requested regarding the situation. The authorities spoke with the developers of a number of projects, including Sports City, and attempts are being made to purchase land from farmers through communication.
