Supreme Court Hands Over 16 Stalled Supertech Projects to NBCC

New Delhi: In a landmark and homebuyer-friendly verdict, the Supreme Court of India has directed that 16 stalled residential projects of Supertech Limited be taken over and completed by NBCC (National Buildings Construction Corporation). The decision brings major relief to nearly 51,000 affected homebuyers across Delhi–Noida and other regions who have been waiting for possession for years. The Court has ordered that the projects be completed within two years, marking one of the most significant judicial interventions in India’s real estate crisis.

Supreme Court puts homebuyers first

The judgment was delivered by a Bench headed by Justice Surya Kant. The Court made its position absolutely clear, stating that homebuyers are the top priority in this case.

The Supreme Court ruled that:

  • Completion of construction and delivery of flats must take precedence
  • Homebuyers cannot be treated as investors or speculators
  • Claims of financial and other creditors will be addressed at a later stage

Upholding the earlier order of the National Company Law Appellate Tribunal (NCLAT), the Court entrusted NBCC with the responsibility of completing the 16 stalled Supertech projects. It also directed that there should be no judicial or administrative interference in the execution of the work.

Article 142 invoked for complete justice

Invoking its extraordinary powers under Article 142 of the Constitution, the Supreme Court observed that the case goes beyond technical legal issues and directly impacts the lives, futures and dignity of thousands of families. The Court acknowledged that many homebuyers have suffered for over a decade, paying rent and EMIs simultaneously while facing mental and financial distress. The judgment underlined that such citizens deserve real, effective and time-bound relief.
