Court steps in after prolonged delays
The High Court’s intervention follows repeated complaints by residents regarding inordinate delays in the registry process. Many buyers had already taken possession of their flats but were deprived of official ownership due to the builder’s failure to execute the registration. After continuous follow-ups, protests and lack of resolution, affected residents approached the court seeking justice.\
Residents raise concerns over builders’ inaction
According to residents, several families have been living in the society for the past few years, yet the registry of their flats remained pending. They stated that full payments had been cleared long ago, but the builder failed to initiate the legal process required for property transfer. The issue not only created uncertainty but also restricted residents from exercising full ownership rights over their homes.
Authority also made a party in the case
During the legal proceedings, the Greater Noida Authority was also made a party in the case to ensure administrative accountability. The court, after hearing all sides, issued clear directions that the registry process must be completed within the stipulated three-month timeline.
Order brings relief and sets a precedent
Following the court’s order, residents have expressed relief and optimism. The decision is being seen as a significant precedent for other homebuyers facing similar issues across the region. It reinforces the principle that developers must adhere to commitments and cannot indefinitely delay registrations after receiving full payment. The ruling is expected to not only resolve long-standing disputes in Mahagun Mantra Society but also encourage affected buyers in other projects to seek legal recourse for the timely registration of their properties.
