Golf Homes and Kingswood : Residents march to protest against the arbitrariness of Ad Hoc AOA

Residents upset due to illegal recovery of temporary AOA, preparing to go to the Supreme Court with these issues

Greater Noida West: On Sunday, home buyers of Amrapali Golf Homes and Kingswood in Grater Noida West demonstrated against the arbitrariness of the ad-hoc AOA. Homebuyers allege that these demands are illegal and we will not follow them. About 200 home buyers raised their voices in this meeting.

Know what are the illegitimate demands of the Ad hoc AOA

As per the Home buyers, the ad hoc AOA are levying unnecessary demands on the innocent homebuyers. Some of them are an entry fee of Rs 10 per square foot, maintenance charge of Rs 3 per foot, membership of Rs 1,000 unregistered temporary AOA. Not only this, if one wishes to rent out their house, they have to give 15 days rent to the temporary AOA.

‘Payment of Rs 0.5% to temporary AOA should be stopped’

The homebuyers of Golf Homes allege that the ad hoc AOA has been appointed in an unethical manner. AOA should have been formed only through elections. All the home buyers decided that the maintenance charge of ₹3 per square foot fixed by the temporary AOA is hypothetical. Everyone is ready to pay maintenance of ₹2 per square foot, but any unethical and illegal demand will not be accepted.

‘The long wait of 14 years and still so much pain to bear’

Anita Singh, Homebuyer says, “We have hopes from NBCC as Amrapali builder left us of nowhere, as Nothing was received after a long wait of 14 years. We thought this change would bring something good. When we received the keys, the temporary AOA imposed various conditions on it. Because of this, there is a lot of anger among all of our homebuyers.”

Apart from this, issues like non-completion of construction in some blocks within the stipulated time, lack of quality, arbitrary demand of interest and not having representatives in the temporary AOA from all the blocks were discussed. People say that people are getting houses after a long wait of 14 years.

‘Supreme Court is the only way to go now’

Despite repeated demands from the buyers, the representatives of the temporary AOA are not coming forward and meeting them. The problems of home buyers are increasing day by day and no cooperation is being received from the court receiver in this matter. Homebuyers have alleged that they will approach the court receiver against the temporary AOA and if the matter is not heard there, they will apply to the Supreme Court.

Homebuyers mutual condtions

1) All the flat buyers agreed that all those flat buyers who have taken NOC from CR Office and NBCC should be immediately given entry into the society without any conditions.

2) Ad hoc flats offered by AOA without any detailed discussion at ₹10 per square feet society entry fee, ₹3 per square feet monthly maintenance charge, ₹1000 AOA membership charge, 15 days rental charge, 0.5℅ sales charge etc. The buyers rejected and all thought that any charge should be made after a detailed discussion and based on a majority vote of the flat buyers.

3) Attendees rejected the Ad-hoc AOA created by CR. Everyone thought that one representative should be selected from all 8 clusters and there should be at least 2 women representatives in it. This ad hoc AOA should be dissolved immediately and a constitutional AOA should be elected.

4) At present, in most of the societies of Greater Noida West, the monthly maintenance charge is between ₹ 1.50 to ₹ 2.00, hence under any circumstances the monthly maintenance charge should not be more than ₹ 2.00.

5) The verification process of Cluster A, which has been ready for the last 6 months, should be started as soon as possible and the flat handover should be filled immediately.

6) Cluster D, J, K, L and M which are not ready yet, should be prepared as soon as possible and everyone should be given positions immediately. The building structure of Cluster K has not been completed yet, hence maximum workforce should be appointed in that Cluster so that handover of K-Cluster can be done along with all the other clusters.

7) Interest is being demanded from some people in the name of late payment which is completely wrong. If late payment is to be taken, then from July 2023, NBCC should pay interest to the flat buyer for the number of days/months for which the flat delivery is delayed.

8) The quality of the plates is very bad, it should be investigated by an independent agency and further action should be taken based on that.

9) All these demands should be met with CR in the next few days and if CR does not take action on these things then further legal action should be taken.

10) It should be ensured that in the upcoming Navratri, as many flat buyers as possible who have received NOC shift to society.

Pranav, an Amrapali Homebuyer says, “Meeting was good. Approx 200 home buyers came and they all are against such extortion demand in the form of entry fees, especially for Golf home buyers we have conveyed to CR for unnecessary demand still now no reply from their end”

Sheetesh K Pathak, Amrapali Homebuyer says, “Golf Homes is getting finished by NBCC. The ad hoc AOA was created 2 months back, which is senseless. We do not agree with them and will protest again if anything happens.
