Greater Noida West : The Allahabad High Court has directed the Greater Noida Industrial Development Authority (GNIDA) to consider and decide representations submitted by homebuyers of the LA Residentia project regarding the execution of their flat registries, in accordance with law and preferably within three months.
A Division Bench comprising Justice Siddhartha Varma and Justice Kunal Ravi Singh passed the order on September 23, 2026, in Smt. Kiran Kapoor and 42 Others v. State of U.P. and 4 Others, Writ-C No. 26874 of 2026.
Homebuyers approach High Court
The petitioners approached the High Court seeking execution of their sub-lease deeds and registration of their flats. According to the petitioners, they had fulfilled their payment obligations to the developer and completed the required formalities.
The registry issue has remained pending amid disputes concerning outstanding dues and other liabilities between LA Residentia Developers Pvt. Ltd. and GNIDA.
During the proceedings, the petitioners also relied on the Supreme Court’s judgment in Ram Kishore Arora v. Bank of Maharashtra & Ors., Civil Appeal No. 11052 of 2025, decided on December 16, 2025.
GNIDA given a three-month timeframe
The High Court directed GNIDA to consider and decide the petitioners’ representations expeditiously, preferably within three months from the date of service or production of the certified copy of the order.
The direction gives the homebuyers a defined timeframe within which the authority is expected to take a decision on their representations concerning execution of the sub-lease deeds.
Relief for LA Residentia homebuyers
The order is a significant procedural development for LA Residentia homebuyers who say they have completed their payment obligations and are awaiting execution and registration of their sub-lease deeds.
However, the court’s direction requires GNIDA to consider and decide the representations in accordance with law. It does not, by itself, direct immediate execution of the registries.
